May a convicted person be prohibited from occupying their own home?


The Criminal Division of the Court of Cassation held that a person sentenced to a suspended sentence may be barred from entering the location of their home if their presence is likely to constitute a threat.

However, the convicted person must be given the opportunity to challenge such a prohibition, as it may infringe upon their property rights.
