Illegal Practice of Law: Liability of an Insurance Claims Representative

The French Court of Cassation upholds conviction for unauthorized legal practice by an insurance claims representative assisting traffic accident victims.


On 7 May 2025, the French Court of Cassation upheld the conviction of a service provider acting as an "insurance claims representative" for the unauthorized practice of legal advice and the drafting of legal documents.

The defendant offered traffic accident victims assistance in their compensation claims, including legal advice and the drafting of responses to insurers' offers.

The Court of Appeal of Nîmes held that these activities constituted legal consultations and private acts reserved to lawyers. The Court of Cassation confirmed that the defendant's activities amounted to unlawful legal advice, even at the amicable stage, and that the prohibitory measures imposed were appropriate.

This decision reaffirms that assistance of victims of personal injury claims in their compensation procedures falls exclusively within the professional scope of lawyers.
