Filming an Intoxicated Person: Is It Legal?

Can a person who is intoxicated be filmed by the police without their knowledge?


The Criminal Division of the Court of Cassation held that police officers are not required to inform an intoxicated person that a body-worn camera is being used to record the intervention.

The Court reasoned that, due to their condition, the person being filmed is unable to comprehend the significance of being informed that a camera has been activated.
